Pho Ha Noi, a neighborhood Vietnamese restaurant in the Bay Area of California, has found itself in the unanticipated position of being at the center of a controversy. The Bay Area is home to a number of prominent technology companies. The ignition? A nontraditional approach to the policy of the required service price, which does not differentiate between different sized parties.

The incident started when a customer who was eating alone decided to post their experience on the website Reddit. On September 15, 2023, a user on Reddit using by the handle u/TRTL2k submitted a snapshot of a receipt from a restaurant located in Cupertino. The ticket showed that an automatic service charge of 18% had been applied, which is a cost that is generally allocated for bigger parties in many businesses.

The message quickly spread like wildfire over the internet, racking up thousands of hits, shares, and comments within a matter of hours. The internet community was divided along ideological lines. Others have stated their support for the workers in the service sector, despite the fact that many people have expressed astonishment and displeasure over the situation.

Tipping is more than simply a habit in the United States; it’s profoundly embedded in our society as a whole. Because the federal minimum wage for tipped workers is just $2.13 per hour, gratuities often fill in the gap to make up the difference between that and a pay that is sufficient for living. However, due to the rapidly rising cost of living in the Bay Area, there are several issues that are specific to the region that firms and workers must face.

Helen Nguyen, co-owner of Pho Ha Noi, decided to respond to the bad comments left for her business after a post on Reddit received over 5,000 responses, many of which questioned the restaurant’s service cost. Prior to this, Nguyen’s company had been plagued with poor customer feedback. She vehemently defended the restaurant’s choice, explaining that adding the service fee was a strategic move to assure equitable remuneration for over one hundred devoted staff working across all of their Bay Area locations, and she did so with much enthusiasm.

According to Fox 11, the business reportedly alerted its customers of this move in November 2022 via a post on Yelp.

Nguyen further stressed the significance of the fee by stating that it is a lifeline. It helps to assist workers earning minimum wage by offering vital benefits like as health insurance and tackling the ongoing issues of recruiting in an area where living expenditures continue to rise at a rapid rate.

The question “Was it disclosed beforehand?” reveals that the Reddit user Aggressive-Variety60 is concerned about the eatery’s lack of openness. The menu and pricing list have to be updated so that they reflect the correct prices! Tipping is left up to the discretion of the customer.” There was widespread consensus among respondents that the service fee should be disclosed to clients before they make their purchases.

According to the story, however, regulars at the restaurant in Cupertino have been aware of the 18% service fee since it was implemented the previous year. It is pointed out on both the menu and the sign that is located beside the front door.

Reddit user yomammaaaaa posted in the thread that “it is disclosed beforehand,” which is an attestation from another user named yomammaaaaa. I’ve been there a few times, and not only do they have a sign in the window, but it’s also included on the menu. It shouldn’t come as much of a shock, but I can see how it might be taken the wrong way if any of those things were overlooked.

According to iMadrid11’s post on the topic, “Service charge is synonymous to Gratuity aka Tips.” It’s not always a terrible thing when restaurants add a service fee to the bill. As long as the restaurant doesn’t take it from the staff without their permission.”

Nguyen continued their conversation with the San Francisco Gate by stating, “We are not the first to do it.” “A considerable number of restaurants began including a 20% or 25% service fee quite some time ago. Nobody offered any opinion…People seem to be looking in the direction of my restaurant; why is that?

Nguyen further explained that as owners of the restaurant, they aim to improve the level of service that they give to their customers. At the same time, they have to find a way to keep excellent employees by paying them properly so that they won’t leave their employment.

Everyone puts forth a lot of effort. I want to treat our employees with respect,” she said.
